Terms of Service

These Terms of Service (the "Terms") govern your use of SubHub Pro, a job marketplace that connects general contractors and subcontractors. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The service

SubHub Pro is an online marketplace where general contractors ("GCs") post jobs and subcontractors ("subs") browse those jobs, request to bid, and submit bids. Members can also build mutual networks with each other and receive notifications about activity relevant to them. Browsing the marketplace is free; a paid membership is required to post jobs, request to bid, submit bids, or connect with other members.

SubHub Pro is operated from New Hampshire, USA. We provide the platform on which members find each other. We do not perform construction work, we do not employ members, and we do not supervise, direct, or control any work arranged through the service.

2. Accounts and eligibility

To use SubHub Pro you must be at least 18 years old and using the service for business purposes on behalf of a trade business you are authorized to represent. The service is not offered for personal, household, or consumer use.

You are responsible for the accuracy of the information in your account and profile, including your business name, trades, and contact details, and for keeping your login credentials secure. You are responsible for all activity that happens under your account. Notify us promptly at nic@subhub-pro.com if you believe your account has been compromised.

You may register as a GC or a sub. Some features are available only to one role, and you agree to use the role that accurately reflects how your business operates on the platform.

3. Subscription and billing

Full membership costs $39 per month, for both GCs and subs. Your subscription is billed monthly in advance through our payment processor, Stripe. By subscribing you authorize recurring monthly charges to your payment method until you cancel.

You can cancel at any time through the billing portal available from your account page. Cancellation takes effect at the end of the current billing period; you keep paid features until then, and you will not be charged again after that. Except where required by law, payments are not refundable and we do not provide refunds or credits for partial billing periods.

Prices may change. If we change the subscription price, we will give you advance notice, and the new price will apply from your next billing period after the notice period.

4. Referral program

Members may refer others to SubHub Pro. When a person you refer becomes a paying subscriber, you receive a $5 credit applied against your subscription, and the referred member receives $5 off their first month. Referral credits are capped at 7 credits per calendar month per member. Credits have no cash value, cannot be transferred or redeemed for cash, and apply only to future subscription charges.

We may withhold, reverse, or revoke referral credits and suspend accounts where we reasonably believe the program is being abused, including self-referrals, fake or duplicate accounts, misleading promotion, or referrals obtained through spam. We may modify or end the referral program at any time; earned credits already applied to your account will be honored.

5. User content and acceptable use

You retain ownership of the content you post on SubHub Pro, including job posts, bids, and profile information. You grant us a non-exclusive, worldwide, royalty free license to host, display, and distribute that content as needed to operate the service, for example showing your job post to subs in the feed.

You agree not to:

  • post content that is false, misleading, defamatory, or infringing;
  • post jobs you do not intend to award or bids you do not intend to honor;
  • misrepresent your identity, business, licensing, or insurance status;
  • harass, spam, or solicit other members outside the purpose of the service;
  • scrape, harvest, or bulk export member data;
  • attempt to probe, disrupt, or gain unauthorized access to the service or other members' accounts; or
  • use the service for any unlawful purpose.

We may remove content or restrict accounts that violate these rules, at our discretion and without prior notice.

6. SubHub Pro is a venue only

Please read this section carefully. It defines what SubHub Pro is and is not.

  • SubHub Pro is a venue only. We provide a place for GCs and subs to find each other. We are not a general contractor, subcontractor, broker, or agent of any member.
  • We do not verify the licenses, insurance, qualifications, workmanship, or background of any member. Any information members provide about themselves is theirs alone, and you are responsible for performing your own due diligence before working with anyone you meet through the service.
  • We are not a party to any agreement between members. Any contract, bid, quote, payment, or work arrangement is solely between the members involved. Members contract with each other at their own risk.
  • We are not responsible for the quality, safety, legality, timing, or payment of any work arranged through the service, or for resolving disputes between members.

7. Disclaimer of warranties

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error free, or secure, that defects will be corrected, or that any job post, bid, or member profile is accurate or reliable.

8. Limitation of liability

To the fullest extent permitted by law, SubHub Pro and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to the service or any work arranged through it, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims arising out of or related to the service will not exceed the amount you paid us in subscription fees in the 12 months before the event giving rise to the claim, or $39 if you have paid us nothing.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

9. Termination

You may stop using the service and cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms, abuse the referral program, fail to pay subscription fees, or use the service in a way that creates risk or possible legal exposure for us or other members. Where practical we will give you notice and a chance to correct the issue.

Sections of these Terms that by their nature should survive termination, including sections 6 through 8, will survive.

10. Governing law

These Terms are governed by the laws of the State of New Hampshire, USA, without regard to its conflict of law rules. Any dispute arising out of these Terms or the service will be brought in the state or federal courts located in New Hampshire, and you consent to their jurisdiction.

11. Changes to these terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and give notice through the service or by email. Your continued use of the service after changes take effect means you accept the updated Terms. If you do not agree to a change, cancel your subscription and stop using the service.
